When should I call a lawyer?

I’ve been arrested. Am I charged?

If you have been arrested, you may have been charged (if it was approved before or immediately after your arrest). However, in British Columbia, the police do not have the authority to charge a person. That authority rests only with the Crown (prosecutor).

To charge a person, the Crown has to be satisfied of two points: (1) there is a substantial likelihood of conviction; and (2) a prosecution is in the public interest.

Unfortunately, the Crown is often assessing those questions without knowing about the person, or their explanation for what happened. What is the difference between a charge and a conviction?

If I am charged, will that show up on a criminal record check?
